The CSB thinks that they should have applied the OSHA PSM regulation to a unit where it didn’t apply.

However, it seems that a reasonable person would have checked for a flammable atmosphere inside the tank and realized it was at risk for hot work. And the tank probably should have been drained and flushed prior to the hot work.

Lot’s of good ideas from the CSB but, in my opinion, they tend to depend too much on governmental regulation.
